El consentimiento informado en la relación médico paciente en la ciudad de Medellín: análisis jurisprudencial. (Informed consent between doctor-patient relationship in the city of Medellín: jurisprudential analysis)

Resumen

A lo largo de este artículo se mostrará como a través de sus fallos, las altas Cortes Colombianas, han ido llenando los vacíos que frente al consentimiento informado existen en nuestra normatividad actual, creando de este modo las bases en las cuales se debe fundar el consentimiento informado para que sea válido, cimentándose en la autonomía y dignidad del paciente. Igualmente, el artículo pretende mostrar como las diferentes IPS a través de la institucionalización de preformatos escritos de consentimiento informado, han ido desdibujando el objetivo principal de esta figura, dejando de lado los lineamientos propuestos por la jurisprudencia y en muchas ocasiones violando los derechos fundamentales de sus pacientes, convirtiéndolo en un medio de exoneración frente a posibles reclamaciones judiciales. Finalmente, el artículo, busca proponer un nuevo modelo de preformato que pueda ser de fácil utilización por parte de las IPS, sin ir en contravía del objetivo principal de esta figura.

Abstract

Throughout this article we will show how the Colombian high courts have been filling the gaps that exist in front of the informed consent in our current regulations, thus creating the basis on which consent must be based reported
to be valid, building on the autonomy and dignity of the patient. Similarly, the article seeks to show how the different IPS through the institutionalization of overlays written informed consent, have been blurring the main purpose
of this figure, ignoring the guidelines proposed by the jurisprudence and in many cases violating the fundamental rights their patients, making half of exoneration from potential legal claims. Finally, the article seeks to propose a new overlay model that can be easily used by the IPS, without going
counter to the main purpose of this figure
