El código penitenciario y el tratamiento del trabajo. (The prison code and treatment of labor)

Abstract

Las bases de Estado Social de Derecho, en el que se funda el estado colombiano, hace que se garanticen los derechos fundamentales de quienes gozan de la libertad, no obstante, en ejecución de la pena privativa de la libertad, es evidente que muchos de los derechos fundamentales de los condenados van a ser suspendidos y limitados. Sin embargo, en el caso del Derecho Fundamental al Trabajo y el Derecho al Trabajo, hay que tener en cuenta que aunque éste se limita, no se suspende y que el Estado lo garantiza.El artículo que se presenta a continuación, analiza el derecho fundamental al trabajo en el código penitenciario y carcelario, frente a las sentencias de la Corte Constitucional que existen sobre la materia, y lo que busca, es de una manera crítica, cuestionar el tratamiento de dicho derecho en la normatividad colombiana.
