De la racionalidad del poder político del presidente: Un análisis del caso colombiano

Abstract

Colombia presenta una insuficiencia en la racionalización del poder del Presidente lo que en ocasiones parece cambiar el Estado Social de Derecho hacia una Monarquía Constitucional.  Después de un análisis del caso colombiano y una vez evaluados los controles constitucionales sobre el Presidente de la República y las zonas de la Constitución donde no se restringe con claridad las funciones del mismo, podemos concluir que la existencia de vacíos constitucionales que pueden ser abusados es latente, por tanto, es claro que la Constitución de 1991 es un texto vulnerable frente al mandatario.  

Abstract: Colombia shows a failure in the rationalization of the power of President that sometimes seems to change the Social State of Law towards a Constitutional Monarchy. After a review of the Colombian case and and evaluations of constitutional controls on the figure of President of the Republic and areas of the Constitution whereas his functions are not clearly restricted, we can conclude that the existence of constitutional gaps that can be abused is latent. Therefore, it is clear that the 1991 Constitution is weak text in the hands of the executive power.
