El Derecho y la Violencia: Una Polémica Relación Pensada desde Nietzsche y Foucault

Resumen

Se propone revisar las nociones de Derecho y violencia que se presentan (principalmente)en los textos: Genealogía de la moral (1978) y La gaya ciencia (1974) de Nietzsche, y Laverdad y las formas jurídicas (1973), Vigilar y castigar nacimiento de la prisión (2005) enMichel Foucault. Se abordan las nociones de fuertes y débiles, o de aristócratas y plebeyos.Se analiza la relación entre crueldad, memoria y olvido. Se retoma la idea nietzscheana dela justificación del castigo como una construcción a posteriori que legitima una violenciaprimitiva aristocrática. Asimismo se analiza la relación poder-saber-violencia en La verdady las formas jurídicas. Por último, a lo largo del texto se esboza el influjo del pensamientode Nietzsche en la obra de Foucault.

Law and violence: A controversial relationship thought from Nietzsche and Foucault

It is proposed to revise the notions of law and violence that occur (mainly) in the texts:Genealogy of Morals (1978) and The Gay Science (1974) Nietzsche, and Truth andlegal forms (1973) Discipline and Punish birth of the Prison (2005) Michel Foucault. Thenotions of strong and weak, or aristocrats and commoners are addressed. The relationshipbetween cruelty, memory and forgetting is analyzed. Nietzsche’s idea of the justification ofpunishment as a post construction that legitimizes a primitive aristocratic violence resumes.It also discusses the relationship power-knowledge-violence Truth and legal forms. Finally,throughout the text the influence of Nietzsche’s thought outlined in the work of Foucault.
