Evolución de los Textos Constitucionales sobre Estados de Excepción en Colombia, entre 1886 y 1991

Resumen

Los textos de las primeras constituciones francesas entre 1789 y 1870, que regularon elestado de sitio, tienen una notoria influencia en el contenido que sobre la misma materiase encuentran en las sucesivas cartas políticas colombianas especialmente en la que,promulgada en 1886, con sus reformas durante el Siglo XX, sirve como antecedente a laConstitución Política de 1991. Esta afirmación no puede, en cambio, extenderse al estadode emergencia económica introducido en Colombia por el Acto legislativo Nº 1 de 1968.Aun cuando no se encuentran normas similares en la Constitución de los Estados Unidosde Norte-América a las cuales pueda atribuirse influencia, es evidente que en momentosde crisis varios presidentes hicieron uso de poderes exorbitantes que pudieron llegar aconstituir violaciones de la constitución pero que el congreso, como se verá, dejó pasar ensu momento como típica muestra del pragmatismo norteamericano.

 

Evolution of constitutional texts on states of emergency in Colombia, between 1886 and 1991.

The texts of the first French constitutions between 1789 and 1870 , which regulated thesiege, have a marked influence on the content on the same subject are in successiveColombian Political Letters especially where , enacted in 1886 , with its reforms duringthe twentieth century , serves as background to the Constitution of 1991. That statementcannot, however, extend to the economic state of emergency introduced in Colombia byNo. 1 of 1968 legislation. Although no similar rules are in the Constitution of the UnitedStates of North America it can be attributed to the influence which it is clear that in times ofcrisis took several Presidents exorbitant powers could come to constitute violations of theConstitution but which Congress, as will be seen, missed at the time as a typical exampleof American pragmatism.
