Alcance del concepto del médico tratante en las acciones de tutela para proteger el derecho al diagnóstico.(Concept guardianships physician transcendence in appeals for legal protection of right to diagnosis)

Resumen

Este documento compara la influencia del concepto del médico tratante en las tutelas relacionadas con solicitudes de ayudas diagnósticas. Inicialmente se tiene en cuenta la definición de médico tratante, su concepto e importancia. Además se hace un análisis de la línea jurisprudencial de la Corte Constitucional sobre solicitudes de pruebas diagnósticas y remisión a especialistas, de acuerdo con las sentencia de tutela proferidas por esta institución entre el 2008 y el 2013.La investigación planteó los siguientes objetivos: a) relacionar las tutelas y verificar cuales contradicen o adoptan el concepto del médico tratante; b) analizar que concepto determinó el fallo del juez: solicitud del médico tratante de la EPS o particular, respuesta del Comité Técnico Científico o petición del usuario; y, c) identificar si el juez falló de acuerdo al derecho fundamental, para concluir que la Corte Constitucional ha determinado que el concepto del médico tratante es vinculante y que debe ser tenido en cuenta al momento de tutelar el derecho.

Abstract

This paper compares the influence of the concept of the treating physician regarding guardianships requests diagnostic aids. Initially one considers the definition of attending physician, its concept and importance. Besides an analysis of the line of jurisprudence of the Constitutional Court on requests for diagnostic tests and referrals to specialists, according to the ruling of protection proffered by this institution between 2008 and 2013 is made.The research raised the following objectives: a) to relate guardianships and check which contradict or embrace the concept of the treating physician; b) analyzing that concept determined the judge’s ruling: application of the treating physician or EPS particular response of the Scientific Technical Committee or demand; and c) identify whether the judge ruled according to the fundamental right to conclude that the Constitutional Court has determined that the concept of the treating physician is binding and must be taken into consideration when defending the right.
