El consentimiento informado en el ejercicio de la actividad médica(Informed consent in the exercise of medical activity)

Resumen

En el presente artículo se realizará una descripción sobre el consentimiento informado en el ejercicio de la actividadmédica, la descripción se hará a partir de algunas posturas legales y fallos jurisprudenciales de las altascortes como son: la Corte Constitucional, la Corte Suprema de justicia y el Consejo de Estado, corporacionesque han ido ampliando el concepto del consentimiento informado y su funcionalidad en el ámbito médico. Para este artículo tendremos como punto de partida una breve historia del consentimiento informado, y sudesarrollo ético y normativo en el siglo XX tanto para la atención médica como para la investigación científica en seres humanos. Igualmente de manera sintética, revisaremos algunos fallos jurisprudenciales que han profundizadosobre el tema del consentimiento informado, y cómo esta figura en los últimos tiempos se ha venidoconvirtiendo en un punto de atención y de estudio dentro del ejercicio de la actividad médica en Colombia. Y porúltimo se concluirá con una descripción sobre factores importantes que la jurisprudencia ha precisado se debentener en cuenta al momento de dar información a un paciente y obtener así su consentimiento.

Abstract

This paper will be a description about informed consentin the exercise of medical activity; this description willbe done in the sentences of some courts as the Constitutional Court, the Supreme Court of Justice and the Council State corporations that have somehow expanded the concept of informed consent and its functionality in the medical field. For this article we will star with a brief history of informedconsent, and ethical and regulatory developmentin the twentieth century for both medical care andscientific research in humans. Also synthetically, we willreview some court rulings that have deepened over theissue of informed consent, and how this figure in recenttimes has been becoming a focus of attention and studieswithin the exercise of medical activity in Colombia.And finally we will conclude with a description ofimportant factors that has been held to be taken into account when giving information to a patient and obtain consent.
